Terms of Service, Privacy, Shipping & Returns

Privacy & Security

Personal information collected by Kelly's Distributors Pty Ltd ("Kelly's Distributors", "we", "us", "our") is treated as confidential and is handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Personal information relates to information about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion provided.

Information Collected via Email

When you email us, we will record your email address and will only use it for the purpose for which you provided it. Your email address will not be added to a mailing list. We will not disclose your email address without your consent, except where required or authorised by law.

Information Collected via Online Forms

When you use our online forms, we may collect your name, email address, street address, telephone number, company name, area of interest, and other personal information you provide. This information is used solely for the purpose for which it was provided. It will not be added to a mailing list, and we will not disclose it without your consent except where required or authorised by law.

Access & Correction

Shipping & Delivery

Shipping & Handling Costs

Shipping and handling costs are calculated based on the size, weight, number, and type of products in your order and the delivery destination. Costs are displayed during checkout prior to payment and on your order confirmation. Changes to the delivery address or time after an order has been placed may incur additional charges. Shipping and handling costs calculated at checkout are based on delivery to the front door of the ground floor.

Delivery Instructions

Unless otherwise specified, orders will be delivered to the front door or a safe place at the delivery address provided. Our drivers may not call or knock upon delivery. It is your responsibility to provide clear delivery instructions at checkout if a specific safe place is preferred and accessible.

Important: Once an order has been delivered to the nominated address or safe place, Kelly's Distributors accepts no liability for loss, theft, or damage to those goods.

Delivery Timeframes

Products listed on our website will typically be dispatched within 24 to 72 business hours. Deliveries may occur at any time, Monday to Friday. Local pickups are available between 8:00 am and 4:00 pm, Monday to Friday only. Standard delivery timeframes are as follows:

  • Metro Areas & Eastern Seaboard of Australia — up to 5-7 business days
  • Perth, Western Australia — up to 7-10 business days

Local Pickup

Orders may be collected from our warehouse at 215 Jackson Road, Sunnybank Hills QLD 4109. Same-day pickup is available for orders placed before 1:00 pm; otherwise, pickup is available the next business day.

Finding our pickup bay: When you drive through the entrance arch at the given address, continue straight and take the first right turn. The warehouse and order pickup point will be on your right.

Standard local delivery to Kelly's business customers is within two business days from receipt of order, subject to delivery suburb and unless otherwise specified.

International Shipping: International shipping is currently unavailable. For export enquiries, please contact info@kellysdist.com.au.
Section 03

Premises Visits & Local Pickup

Entry at Own Risk

By entering the premises of Kelly's Distributors, including our warehouse, car park, loading areas, driveways, and any surrounding grounds at 215 Jackson Road, Sunnybank Hills QLD 4109 (collectively, the "Premises"), you acknowledge and agree that you do so entirely at your own risk.

Exclusion of Liability

To the maximum extent permitted by law, Kelly's Distributors, its officers, employees, agents, and contractors shall not be liable for any:

  • Personal injury, illness, or death sustained by any visitor, customer, or their invitees while on the Premises
  • Loss of, or damage to, any vehicle (including its contents) parked on or passing through the Premises
  • Loss of, or damage to, personal property brought onto the Premises
  • Any indirect, consequential, or economic loss arising from your attendance at the Premises

Vehicle Parking & Movement

Parking on the Premises is unattended and provided on an "as is" basis at the vehicle owner's sole risk. Kelly's Distributors does not accept responsibility for theft, vandalism, collisions, weather damage, or any other loss or damage occurring to vehicles or their contents while on the Premises. Visitors must observe all posted speed limits, signage, and traffic directions.

Visitor Obligations

All visitors to the Premises must:

  • Follow all reasonable directions given by Kelly's Distributors staff
  • Wear appropriate closed-toe footwear in warehouse and loading areas
  • Not enter restricted areas, including operational warehouse zones, unless escorted by authorised personnel
  • Report any hazards, incidents, or injuries to staff immediately
Notice: Our Premises is an active warehouse environment. Forklifts and heavy machinery may be in operation. Visitors must remain in designated pickup areas at all times unless accompanied by staff.

Children & Minors

Children under the age of 16 must be accompanied and supervised by a responsible adult at all times while on the Premises. Kelly's Distributors accepts no responsibility for unsupervised minors.

Section 04

Returns, Refunds & Replacements

All products remain the property of Kelly's Distributors until paid for in full. Goods supplied are subject to Kelly's Distributors' Terms of Trade (a copy may be obtained by contacting info@kellysdist.com.au).

Damaged Products

In the event that products are damaged on delivery due to manufacturing, handling, or transit, you must notify us of the damaged goods within 24 hours of receiving the stock. No claims or returns of damaged products will be accepted without prior authorisation. To report damaged products, contact orders@kellysdist.com.au.

Missing or Incorrect Products

If products are short-delivered or incorrectly supplied, you must notify us within 48 hours of receiving the stock. No claims for incorrect or short supply will be accepted without prior authorisation. Contact info@kellysdist.com.au to report discrepancies.

Out of Date Products

If products are out of date or short-dated upon delivery, you must notify us within 48 hours of receipt. No claims will be accepted without prior authorisation. Contact info@kellysdist.com.au to report date issues.

Change of Mind

No returns or refunds will be provided for change of mind. This includes excess shipping and handling costs, as these are displayed during checkout prior to payment and confirmed in your order summary.

Australian Consumer Law

Nothing in these terms is intended to exclude, restrict, or modify any rights or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable legislation which cannot be lawfully excluded or modified. If goods supplied by Kelly's Distributors fail to meet a consumer guarantee under the Australian Consumer Law, you are entitled to the remedies set out in that legislation.

Section 05

Limitation of Liability

To the maximum extent permitted by applicable law (including the Australian Consumer Law), the total aggregate liability of Kelly's Distributors for any claim arising out of or in connection with these terms, whether in contract, tort (including negligence), statute, or otherwise, shall not exceed the total amount paid by you for the relevant order giving rise to the claim.

Kelly's Distributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, whether arising from contract, tort, or otherwise, even if advised of the possibility of such damages.

Force Majeure

Kelly's Distributors shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, government restrictions, industrial action, supply chain disruptions, transport delays, or utility failures.

Section 06

General Terms

Governing Law

These terms are governed by and construed in accordance with the laws of the State of Queensland, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Queensland and any courts of appeal therefrom.

Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Amendments

Kelly's Distributors reserves the right to amend these terms at any time by publishing the updated version on our website. Your continued use of our website or services after any amendment constitutes acceptance of the revised terms.

Intellectual Property

All content on the Kelly's Distributors website, including text, graphics, logos, images, and software, is the property of Kelly's Distributors or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or otherwise use any content without our prior written consent.

Entire Agreement

These terms, together with Kelly's Distributors' Terms of Trade and any order confirmation, constitute the entire agreement between you and Kelly's Distributors in relation to the subject matter herein and supersede all prior discussions, representations, and arrangements.
